Aqua Sculpt Retreat Liability Waiver & Participant Agreement

By participating in any retreat activities organised or conducted by Aqua Sculpt, I, the undersigned participant, acknowledge and agree to the following terms and conditions:

1. Assumption of Risk: I understand that participating in floating wellness activities, including Floating Pilates, Floating Yoga, Floating Stretch, and Floating Sound Baths, involves inherent risks, including but not limited to physical exertion, slipping, falling, emotional release, injury, illness, or property damage. I voluntarily assume all such risks.

2. Physical Condition & Personal Responsibility: I confirm that I am in good general health, physically fit, and have no medical conditions or injuries that would prevent me from participating safely. I will attend all sessions in a non-intoxicated state, and understand that the instructor may refuse entry if I am deemed unfit. I take full responsibility for my wellbeing during the retreat, and I will inform Aqua Sculpt of any medical conditions, injuries, or concerns prior to participation.

3. Behaviour: Aqua Sculpt retreats are inclusive, supportive spaces that foster belonging and mutual respect. I agree to participate mindfully and with care for myself and others, contributing positively to the group experience.

4. Travel Insurance: I understand that it is my responsibility to arrange appropriate travel insurance to cover any personal, medical, or trip-related incidents that may arise. Aqua Sculpt does not provide travel insurance and cannot be held liable for costs related to illness, injury, cancellation, or lost property.

5. Pregnancy Participation:

   a. Floating Fitness: For safety reasons, Aqua Sculpt does not recommend or accept participation in Floating Pilates, Floating Yoga, or Floating Stretch sessions during pregnancy. Participation during pregnancy is at your own risk, and we are not liable for any resulting issues.

   b. Floating Sound Baths: Pregnant participants may attend Floating Sound Baths but must be aware of potential sensitivities to sound, comfort limitations, and emotional intensity. Participants must choose appropriate positioning (seated/reclined) and consult their healthcare provider if unsure. A pregnancy waiver must be completed prior to attending.

6. Release of Liability: I release and discharge Aqua Sculpt, its owners, instructors, employees, agents, and partners from any and all liability, claims, demands, or causes of action arising out of or related to any loss, injury, or damages incurred during my participation in the retreat.

7. Waiver of Claims: I waive and relinquish any legal claims I may have against Aqua Sculpt, including for negligence or breach of duty, in relation to my participation in any retreat activity.

8. Indemnification: I agree to indemnify and hold harmless Aqua Sculpt, its instructors, staff, and affiliates from any loss, damage, or legal costs resulting from my participation.

9. Photographic Release: I grant permission for Aqua Sculpt to use photos or video footage taken during the retreat for promotional purposes unless I specify otherwise in writing prior to the retreat. I understand that I am not entitled to any compensation, payment, or royalties for such use.

10. Children: Aqua Sculpt retreats are designed for adults. Participants must be aged 18 and over. 

11. Severability: If any provision of this waiver is found to be unenforceable, the remainder shall remain in full force and effect.

12. Personal Belongings: I understand that Aqua Sculpt is not responsible for the loss or damage of any personal belongings during the retreat. I agree to take reasonable care of my possessions and acknowledge that I am solely responsible for their safekeeping.

I have read this liability waiver carefully and understand its contents. I voluntarily agree to be bound by its terms and conditions. I acknowledge that I am signing this waiver freely and without any undue influence.
